Terms and Conditions

1. Introduction

These are the terms and conditions (as amended from time to time) (“Terms”) governing the use of the MyAccount Website (the “Website”). These Terms form a binding agreement between all authorised and registered users of the Website (“you”, “your”, “yours” “user(s)”) and Canada Life International Assurance (Ireland) (“we”, “us”, “our”). Before you click on the “I accept the Terms & Conditions” button, please carefully read these.

Terms and our Privacy Statement. If you do not agree to all applicable Terms and the Privacy Statement, please refrain from using or registering on the Website. The Website is an internet service which allows you to access information (the “Information”) about individual life assurance policies (“Policies” and each a “Policy”) held directly with us by you (in which case you are a “Policyholder”) or held with us by your client(s) (in which case you are a “Financial Adviser”). The provision of the Information to you via the Website is referred to in these Terms as the “Service”. This document contains the Terms governing your use of the Service.

By using the Website you are consenting to be bound by the then current Terms and our Privacy Statement.

Nothing in this site shall be deemed to constitute financial or other professional advice in any way. You should consult a professional adviser if you require any financial advice. If obtaining a quote in relation to a Canada Life International product from this site you should not rely solely on the information contained within the site pages. You should carefully read the policy documentation and/or terms and conditions relating to any specific product before purchasing.

The capital value of investments and the income from them can go down as well as up and an investor may not get back the amount invested. If you have any doubts at all about investing you should consult a financial adviser.

Nothing in these Terms shall affect any of your statutory rights where you access the Website and use the Service as a consumer, except to the extent permitted by law.

3. User access type

The Service is only accessible by authorised Policyholders and Financial Advisers who register with us. If you are not a registered Policyholder or Financial Adviser, you may not access the Service under any circumstances.

3.1 Policyholders: If your user type is Policyholder, your login will allow you to see details of your own Policy with us. You will not be able to and are not permitted to view details of any other users' Policies via the service.

3.2 Financial Advisers: If your user type is a Financial Adviser and your login will allow you to see details of Policies held by all policyholders associated with your Agency Number. You will not be able to and are not permitted to view details of any policies associated with other users’ Agency Numbers.

 

4. Provision of Service

4.1 You agree that your use of the Service including but not limited to your use of your username, password, PIN Code and answer to your security question, each provided in connection with the Service (together, “Your Login Details”) is subject to these Terms as they may be amended by us from time to time (see clauses 4.8 and 8 below). You also acknowledge that each Policy remains subject to the individual Policy terms and conditions relating to it.

4.2 We understand the importance of the security of the Service and take all reasonable steps to ensure the security of the Website and your personal information and, where applicable, that of your clients.

4.3 Access to the Service and to the Website is granted on a temporary basis and we reserve the right to withdraw or amend the Service without notice. We will not be liable if for any reason the Service is unavailable at any time or for any period.

4.4 From time to time, we may restrict access to some parts of the Website, or the entire Website, to different categories of registered user without notice.

4.5 At our sole discretion, we may terminate the Service or any user’s access to the Service from time to time for security, general administration or for any other reason. We will inform you of such action as soon as reasonably possible. After receipt of such notification and subject to the terms of the notification, you may be required to re-register for the Service and/or to change Your Login Details.

4.6 We have the right to disable any access to the Service, at any time, if in our reasonable opinion you have failed to comply with any of the provision of these Terms.

4.7 You are solely responsible for providing and maintaining any equipment and software that you may need to use to access the Service. Technological changes from time to time may make the equipment or software that you currently use to access the Service obsolete or otherwise unsuitable. We reserve the right to change the Service at any time even if this means that you will need to update or replace the equipment or software that you use to access the Service and we accept no responsibility or liability for any costs, losses or damages that you may incur as a result of such changes. We shall use all reasonable endeavours to give you notice of such changes to the Service. You are solely responsible for any telecommunications costs that you incur whilst using the Service.

4.8 We may amend these Terms from time to time (and will give you notice thereof) in accordance with clause 8. If any changes are made you will be notified when you log into the Service thereafter. The notification will tell you the effective date of the latest Terms that are in force and will display them to you and ask you to accept them prior to entering the Website. Clicking the “I accept the Terms & Conditions” button and/or continued use of the Service after receipt of this notification will be deemed acceptance of the revised Terms. You should ensure that you read these Terms every time you use the Service to ensure that you are still in agreement with their contents. 4.9 When accessing the Service, you undertake to take all reasonable measures to ensure:

4.9.1 that your and, if applicable, your clients’ information is kept confidential;

4.9.2 that you secure Your Login Details and any other information necessary to log on to the Website at all times and do not share this information with any other person or party;

4.9.3 that you do not accidentally or deliberately share Your Login Details or any other information necessary to log on to the Website with any other person or party;

4.9.4 that the environment from which you are accessing the Website is secure and protected from malicious viruses, malware or other software designed to infiltrate or damage computer systems;

4.9.5 that all persons who access the Website through your internet connection are aware of these Terms, and that they comply with them; and

4.9.6 Financial Advisers: that you observe and comply with your obligations under these Terms and under the Irish Data Protection Acts 1988 and 2003 and all other applicable data protection laws (“Data Protection Laws”), each as amended from time to time.

 

5. Indemnity

5.1 You undertake to us to comply strictly with these Terms. You acknowledge that your compliance with these Terms is designed to minimise the risk of unauthorised use of the Service. You agree to indemnify us in full in respect of any loss or damages which may arise to us, other users or any third party as a consequence of your non-compliance with these Terms. You will not be liable for any such loss or damage to the extent that it is caused solely by our negligence, willful default or fraud.

 

6. Use of Your Login Details

6.1 Your right to access the Service is personal to you and you must take all steps necessary to ensure that no other person is permitted to gain access to the Service by using Your Login Details. Under no circumstances should you keep a written or electronic record of Your Login Details in a form which could be accessed by another person. You must treat Your Login Details as confidential and not disclose them to any other person. In the event that another person does gain access to Your Login Details or to the Service, as a result of a breach by you of this clause, you acknowledge that we, subject to any obligation we may have under law, will not be responsible or liable for any damage, loss, cost, liability or expense that may be suffered or incurred by you or any other person as a result of such access.

6.2 If you become aware of, or suspect, any unlawful or unauthorised use of the Service or of any of Your Login Details, you must immediately contact us: telephone us on +44 (0) 1624 820 200 Monday to Friday or email focus@canadalifeint.com.

6.3 You may only access the Service for the purposes of viewing Information about you, your Policy, or, if applicable, your clients or your clients’ Policies. Should you access or attempt to access information relating to any other individual you may be in breach of Data Protection Laws. If we form a reasonable belief that you are in breach of Data Protection Laws, we may notify the Data Protection Commissioner (or any other applicable supervisory authority responsible for overseeing Data Protection Laws). We may also withdraw your permission to use the Service and disable Your Login Details.

6.4 We have the right to disable Your Login Details at any time if in our opinion you have failed to comply with any of the provisions of these Terms.

In the absence of any negligence on our part, we may rely on all orders, instructions and other communications given or entered by you or anyone else using Your Login Details and you will be bound by any agreement entered into or expense incurred on your or, if applicable, your client’s behalf or loss suffered by you or, if applicable, your client as a result of or in connection with the reliance by us on such orders, instructions or communications.

Financial Advisers

6.5 If you cease to be authorised by a client to use the Service, or for any other reason, you undertake to inform us immediately so that your right to access the Service in respect of that client can be suspended.

6.6 You shall ensure that you process the Information and otherwise use the Service at all times in accordance with Data Protection Laws and where necessary, that you have obtained your clients’ permission/consent to access the Service and use/process the Information in accordance with the provisions of these Terms.

 

7. Your Obligations

7.1 You agree and confirm to us each time you use the Service, that:

7.1.1 you have all necessary power, authority and approvals to enter into and perform your obligations under these Terms;

7.1.2 by entering into these Terms and by utilising the Service you do not violate, contravene or conflict with any law, regulation, rule, judgment, contract or other instrument binding on you, or, if applicable, your organisation, your client or any of your client’s assets. You confirm that you are not subject to any foreign securities or other laws which may prohibit or limit your use of this Website;

7.1.3 in accepting these Terms, we have not made, and you are not relying upon, any statements, representations, promises or undertakings that are not contained in these Terms.

7.2 You accept full responsibility for monitoring your login to the Service. You agree to notify us immediately in writing if you become aware of:

7.2.1 the loss, theft or unauthorised use of any of Your Login Details;

7.2.2 any failure by you to receive a message or partial message indicating that an instruction submitted by you by any means was received, rejected and/or acted upon; or

7.2.3 any inaccurate information provided to you via the Website relating to your account balances, records or assets, money held or transaction history or any other information relating to you or your Policy, or, if applicable, your clients or your clients’ Policies.

7.3 You agree to maintain a current email address and to keep us informed of any change to your email address, in order to receive ongoing communications from us in relation to the Service.

7.4 We make no warranties, undertakings or representations regarding the security of email communications whether sent to you from us or sent from you to us. We may send information to you via email, which could constitute confidential financial information relating to you or your client, in which case, prior consideration will be taken as to the associated risk. Any information sent to us by you via email shall be sent at your own risk.

 

8. Termination and Variation

8.1 You may terminate your right to use the Service by giving notice in writing to us by post or by email. Your notice will be effective on receipt by us and your access to the Service will be terminated.

8.2 We may terminate or suspend your right to use the Service and such termination or suspension may take effect immediately. In this event, we will give you notice in writing by post or by email as soon as reasonably possible. However, this will not affect instructions already received by us, whether or not we have already carried them out.

8.3 We may change, amend, supplement, or delete any part of these Terms for any one or more of the following valid reasons and will give you notice of such changes in accordance with clause 4.8:

8.3.1 to reflect changes, or anticipate changes, to the law, or interpretation of the law, codes of practice or the way that we are regulated;

8.3.2 to reflect a decision or recommendation made by, or a requirement of, a court, ombudsman, regulator or similar body or an undertaking given to the Central Bank of Ireland, the Data Protection Commissioner in the Republic of Ireland or any other regulator;

8.3.3 to reflect changes in market conditions;

8.3.4 to correct mistakes;

8.3.5 to reflect changes in technology, or to provide for the introduction of new or improved systems, methods of operation, services or facilities;

8.3.6 to make these Terms easier for you to understand or fairer to you; or

8.3.7 to reflect changes made to the individual terms and conditions applying to your Policy or Policies.

8.4 If We vary these terms you will be notified via the Website.

 

9. Limitation of liability - Your attention is drawn to this clause

9.1 We make no warranty, undertaking or representation that the Service will be accessible at all times. If the Service is temporarily unavailable or restricted for technical, administrative or other reasons, we do not accept any responsibility and will not be responsible or liable for any loss or damage arising out of, or in connection with, loss of use of the Service. In the event that the Service is unavailable at any time, you can obtain information on your Policy by calling us on +44 (0) 1624 820 200 Monday to Friday.

9.2 You acknowledge that your uninterrupted access to the Service may be prevented by certain circumstances beyond our reasonable control (a “Service Disruption Event”) including, without limitation, failure of hardware, software or data services, unavailability, non-functioning or interruption of internet or other telecommunication services, act of God, fire, flood, act of government, war, terrorism, civil commotion or labour dispute. Non-performance by us of our obligations under these Terms will not be a breach of our obligations to you where such non-performance arises directly or indirectly from a Service Disruption Event. We do not accept any responsibility and will not be responsible for any loss, costs or damage arising out of or in connection with any Service Disruption Event.

9.3 We do not accept any responsibility and will not be responsible or liable for the inaccuracy, incompleteness or misleading nature of any information received by you or us or by any other person through the Service which arises because of a data transmission, hardware or software error or as a result of your own or a user’s operating error or which originates from information obtained by you or by another user from any third parties (other than inaccurate or incomplete information received from us or as a result of our negligence).

9.4 You accept that electronic communications, the internet, telephone lines or other telecommunications media may not be 100% secure and communications via such media may be intercepted by unauthorised persons or delivered incorrectly. In consequence, we cannot guarantee the privacy or confidentiality of communications via such media although we will put in place security measures to seek to protect these methods of communications.

9.5 We do not accept any responsibility or liability for any claims by you or, if applicable, your clients for damages or losses arising from or in connection with any inaccuracy, incompleteness or the misleading nature of the Information. We are reliant on information from third parties for the accuracy and completeness of the Information relating to the investment of your Policy or, if applicable, your clients’ Policies. You accept that valuations may fluctuate.

9.6 We do not accept responsibility for any loss arising from actions or inactions taken as a result of any Information.

9.7 For the avoidance of doubt, nothing in these Terms seeks to exclude or limit any liability which we may have for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law or under the rules of the Central Bank of Ireland or the Financial Services and Markets Act 2000 and any subsequent amending or replacement legislation which regulates the carrying out of investment or financial business in the United Kingdom.

9.8 Policyholders:

9.8.1 Subject to clause 9.5, if we are in breach of these Terms or are negligent, we will not be liable for any losses that you suffer as a result, except those losses which are a foreseeable consequence of our breach.

9.8.2 Nothing in these Terms shall affect any of your statutory rights where you access the Website and use the Service as a consumer, except to the extent permitted by law.

9.9 Financial Advisers:

9.9.1 Subject to clause 9.5, to the extent permitted by law, we, other members of the Canada Life marketing group and third parties connected to us hereby expressly exclude:

(a) all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and
(b) any liability for any direct, indirect or consequential loss or damage incurred by you and/or your clients in connection with our Website, the Service or in connection with the use, inability to use, or results of the use of our Website, any websites linked to it or any Information or other materials posted on it, including, without limitation, any liability for loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data and loss of goodwill.

10. Intellectual property rights

10.1 Copyright in the pages of this site, in the screen displaying the pages and in the information, texts, graphics and material contained therein and their arrangement is owned by Canada Life International Assurance (Ireland), unless otherwise stated. All trade marks, service marks, company names, logos and design rights (including your Login Details) are the property of their respective holders and no permission is given by Canada Life International Assurance (Ireland) inrespect of the use of any such trade marks, service marks, company names or logos and such use may constitute an infringement of the holders' rights.

10.2 Reproduction of the pages of this site in whole or in part, without the prior written consent of Canada Life International Assurance (Ireland) , is strictly prohibited unless for private, non-commercial viewing purposes.

 

11. Use of information and confidentiality

11.1 Subject to the terms of our Privacy Statement, and except to the extent that such disclosure is required by law or pursuant to a direction or request issued by the Central Bank of Ireland or other competent regulatory authority, we shall take reasonable steps to ensure that all of your confidential information or, if applicable, that of your clients, held by us in relation to the Service shall only be accessible to us, or our agents or our associated companies and shall be processed or used by them for purposes and in a way compatible with the discharge of our obligations to you under these Terms.

11.2 You shall ensure that all information obtained from us by you relating to our operations, Service, software, hardware and/or systems in connection with these Terms shall be treated by you and, if applicable, your clients in strictest confidence and shall not be disclosed by you to any third party unless it is already in the public domain.

 

12. Viruses, hacking and other offences

12.1 You must not misuse our Website by knowingly introducing viruses, Trojan horses, worms, time bombs, logic bombs, keystroke loggers, spyware, adware or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Website, the server on which our Website is stored or any server, computer or database connected with our Website. You must not attack our Website via a denial-of-service attack or a distributed denial-of-service attack.

12.2 By breaching clause 12.1 above, you may commit a criminal offence. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Service and our Website will cease immediately.

12.3 We will neither be responsible nor liable for any loss, costs or damages caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website/Service or due to your downloading any material posted on it or on any website linked to it or any software required by you to access the Website/Service.

 

13. Linking to the Website

13.1 You may link to our homepage, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

13.2 The Website must not be framed on any other site, nor may you create a link to any part of the Website other than the homepage. We reserve the right to withdraw linking permission without notice.

14. General provisions

14.1 If any provision of these Terms is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

14.2 If we fail to insist upon strict performance of any of your obligations under any of these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled under these Terms, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of your obligations under these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

14.3 Headings in these Terms are for convenience only and will have no legal meaning or effect.

14.4 All correspondence will be and has been made in the English language, including these Terms.

14.5 Telephone calls, Website use and electronic mail between you and us may be recorded. These recordings will be our sole property and may be used as evidence in the event of a dispute.

14.6 These Terms and any document expressly referred to in them represent the entire agreement between you and us in relation to their subject matter and supersede any prior agreement, understanding or arrangement between you and us, whether oral or in writing.

14.7 Both you and us acknowledge that neither you nor us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between you and us except as expressly stated in these Terms.

16. Governing law and jurisdiction

16.1 These Terms shall be governed by Irish Law.

16.2 The courts of Republic of Ireland will have exclusive jurisdiction to settle any claim or matter arising under or in relation to these Terms.

16.3 We do not warrant, either expressly or impliedly, that the provision of either the Information or the Service itself outside the Republic of Ireland is compliant with the relevant local laws or regulations or that either the Information or the Service can be legitimately used outside the Republic of Ireland.

16.4 Nothing in this clause or in these Terms shall affect any of your statutory rights where you access the Website and use the Service as a consumer, except to the extent permitted by law.

 

17. Financial Adviser's Capacity

17.1 Financial Advisers: If you are entering these Terms in the capacity of an employee you are advised that by signing these Terms you are binding your employer to these Terms. You warrant that you have all relevant authorisations and permissions from your employer to sign this document.
