Gift hold-over relief

Find out when hold-over relief applies and how a gain can be held over when gifting an asset.

Learn how gift hold over relief works in the UK

Hold-over relief is available to individuals and trustees of a settlement providing the recipient of the gift is resident in the UK. Gifts between spouses and civil partners don’t trigger capital gains.

What is hold-over relief? Hold‑over relief allows certain gifts to be made without triggering an immediate capital gains tax bill, by postponing the gain until the recipient eventually disposes of the asset.

This briefing note explains when hold‑over relief is available to individuals and trustees, which assets can qualify, and how the deferred gain affects the recipient’s future tax position. It will help you identify planning opportunities where valuable assets can be passed on smoothly whilst managing overall tax exposure.
